Rental Terms and Conditions

Cancellation policy

  • Cancellations must be in writing and are effective from the date we receive and acknowledge receipt of your fax or email.
    For Monthly and Christmas/New Year Rentals:
    • Cancellations made from the day of confirmation up to 120 days before arrival – 20% of the total rental as cancellation fee.
    • Cancellations made between 119 and 90 days prior to arrival date: 50% of total rental is non-refundable.
    • Cancellations made 89 days or less prior to arrival: 100% of total rental as cancellation fee.
    For weekly rentals:
    • Cancellations made from the day of confirmation up to 90 days before arrival: 20% of the total rental as cancellation fee.
    • Cancellations made 89-30 days prior to arrival — 50% of total rental as cancellation fee.
    • Cancellations made 29 days or less before arrival: 100% of the total rent as cancellation fee.

1 . General : Your Vacation Rental (“the Company”) is a corporation registered in Alberta. MexicoVacationRental.org acts as a booking agent. Arranges vacation accommodation reservations and bookings for the vacationer (“the renter”) as agents for the owners of the vacation accommodation (“the owner/property manager”).

2. Terms of payment:

  • 50% of the total rental price must be paid within 48 hours from the moment the rental contract is presented.
  • Reservations will be confirmed by email by the Company upon payment of the deposit.
  • The receipt of any deposit prior to written confirmation of the reservation by the Company shall not constitute acceptance of any reservation.
  • All payments will be made to the Company by credit card or bank transfer.
  • Accepted credit cards include: Visa and Mastercard

Monthly Rentals and Christmas / New Years:

  • The balance will be due 90 days before the start of the vacation.

Weekly Rentals:

  • The balance must be paid 30 days before the start of the holidays, except Christmas and New Years.

3. Guest cancellation:

For monthly and Christmas/New Year rentals:

  • Cancellations made from the day of confirmation up to 120 days before arrival – 20% of the total rental as cancellation fees.

4.  Company Cancellation:

If the Property becomes unavailable prior to guest occupancy, the Company will use reasonable endeavors to substitute a reasonably comparable Property. The guest will be informed of this as soon as the Company becomes aware of it. If Company is unable to substitute a reasonably comparable Property, Company will refund 100% of all advance rental payments.


5. Availability of the property:

In the event that the property is not available, the Tenant will exempt the Owner from liability. The Company will offer to reschedule at the same property for arrival within 12 months. Any difference in rate between the original reservation and the rescheduled time will be the responsibility of the Renter. If the property is not available to reschedule, all monies received will be refunded.

6. Use of the Property/Limitation of Liability:

The Renter will use the property and its facilities in accordance with these Booking Terms and Conditions and the attached Booking Notes and will do so at his own expense. Renter agrees to indemnify and hold Company and Owner/Manager harmless from any claims for damages. or costs that the Renter’s family or guests may claim against them as a result of personal injury, illness or death, or loss of or damage to property, however caused, arising out of the use of the property and its facilities. Renter itself hereby releases and discharges Company and Property Owner/Manager from any claims for damages or costs that it may claim against them as a result of personal injury, illness or death, or loss or damage to the property. , whatever the cause,

7. Alterations to property description/inventory:

The information contained in any printed materials and on the website is believed to be accurate at the time of printing/viewing. However, the Company reserves the right to make changes to them and the Company will endeavor to inform the Renter of such changes. If the modifications refer to fundamental elements or services, the Company will try to provide comparable fundamental elements or services. If these comparable items or services are found to be unacceptable to Renter, Company will have no other responsibility than to provide adequate reimbursement for those unavailable essential items or services. The fundamental elements refer to the water, plumbing and electrical systems, major appliances such as refrigerator and stove. Fundamental items do not refer to recreational items such as boats, motors, televisions, WIFI or satellite These items are provided at Owner’s discretion as an added feature for Renter’s use. While every effort will be made to ensure that such equipment functions properly while on vacation, in the event of a breakdown or other situation where these items are not available during the vacation period, neither the Company nor the Owner/Manager of the property are held responsible. to replace or reimburse the Renter for the lack of use of these elements.

8. Check in – Check out time: Check in is after 4:00 PM . and check out is before 11:00 AM . Unless otherwise agreed with the Company, the 11:00 am departure time is crucial for the cleaning contractor to perform cleaning duties. Therefore, please note that unauthorized late checkouts will be subject to a $100.00 charge in the event the contractor’s cleaning crew is unable to enter the vacation rental facility. Departure: Be sure to leave the unit in the same general condition it was in when you arrived, including:

  • Dishes, pots, pans, cutlery, and utensils are washed, dried, and put away.
  • The barbecue grill is clean.
  • Windows and doors are closed and locked.
  • All lights are off to conserve energy.
  • All garbage and waste is taken to the landfill.
  • The property is left clean and in order.

9 _ Noise : Neither the Owner of the Property nor the Company can control or be responsible for the noise or disturbances caused by the occupants of the properties adjacent or close to the property in question, nor by their relatives or guests.

10 _ Number of people using the vacation accommodation : The number of people present during the day (including children and guests) may not exceed the maximum number indicated in the Inventory Listing of that property, without prior authorization from the Company. All overnight guests must be registered with the company prior to arrival. Tenants exceeding the maximum number stated for the property will be subject to immediate eviction with no refund or an additional nightly charge of $100.00 per person at the Company’s discretion. There will be no subletting of the property. No camping, tenting, or ancillary lodging facilities may be placed on the property without prior written notice.

11. Access : The Renter agrees to allow access to the Property by the Owner and/or the agents of the Company with a 24 hour notice during the holidays. Agents include, but are not limited to, sales agents, rental companies, plumbers, electricians, etc.

12. Repair : the Lessee will keep the property and all the furniture, installations, accessories and effects in or on the property at the beginning of its occupation, whether or not these elements are exposed in the Inventory Listing, in the same state of cleanliness, order and repair they were in.

13. Pets, smoking and other reservation conditions : Renters must comply with the reservation conditions and any other instructions contained in the Property Instructions, Inventory Listing and / or as indicated on the front of it. All of these conditions apply to guests visiting the property, whether they are visiting the property during the day or overnight. Tenants found to be in violation of these conditions will be subject to immediate eviction without refund and/or a fine of $100.00 per day at the Company’s discretion. If pets are allowed at a property, the number of pets is limited to one, unless prior written authorization is obtained from the Company. If a property has “No Pets” or “No Smoking” restrictions, please note that this does not necessarily mean that the property has not had pets or smokers present in some The Company is not responsible for conditions arising from allergies in any property, whether it is indicated as “No Pets” or “No Smoking”, or not. Any Renter occupying a condominium or villa within a condominium complex is expected to abide by and follow the condominium rules provided. These rules will be provided with your reservation package as well as in the unit upon check-in.

14. Furnishings: All company properties are privately owned and individually furnished. Their descriptions were accurate at the time of printing or publication of any advertising, but subsequent renewals by the Owner may result in changes, the company is not responsible for ownership changes made by Owners, or for any conditions in the property beyond our control upon arrival. When you arrive at your rental property, it will be clean and ready for occupancy. Certain areas in each rental property are enclosed for the OWNER’s personal storage and are not included in this rental.

15. Construction Disturbance : The potential for construction and maintenance disturbance exists. There is no requirement for the company to notify the lessee prior to the start of a project. We are unable to move guests, reschedule or make price adjustments due to construction. No refund or rate adjustment will be made for any disturbance such as construction on nearby properties or loud parties at other villas, condos or hotels.

16. Keys : The Renter agrees to return the key to the Company upon check-out or leave it at the property according to the specific instructions for that property. Replacement keys are provided at a cost of $200.00 (two hundred pesos 0010 MN),.

17. Electricity : The Lessee undertakes to pay the electricity consumption at the end of the rental term. The meter will be read on arrival and again before departure, payment for electricity consumption is due in cash before departure.

18 _ Water: the tenant agrees to bring or treat (boil) drinking water, regardless of the water source of the accommodation of the property that is reserving. Neither the Property Owner nor the Company assume any responsibility for the quality of the drinking water source on the Property.

19. Damage/Non-refundable Damage Insurance Fee (ARDI): Renter agrees to pay a non-refundable damage insurance fee of $55. This fee provides coverage of up to $1500 USD for accidental and inadvertent damage to property. This insurance rate does not cover intentional damage, theft, unintentional and incidental damage in excess of the amount of coverage purchased, required thorough cleaning at check-out, and smoking in non-smoking units. The Guest authorizes the Company to charge the Guest’s credit card in the event of the exclusions mentioned above. The Guest will be notified of any damages/costs in writing. Guest assumes full responsibility for any items damaged due to guest misuse or negligence or action, except for normal wear and tear reported to Company within 24 hours of check-in, and for any items that miss.

20. Privacy Policy : All information we collect is for internal evaluation purposes. By providing this information, you consent to our collection, use, handling, and disclosure to the property owner of any information set forth in the Property Rental Application related to your stay.
 
I have read, understand and agree to abide by the Terms and Conditions set forth above. I understand that the Owner, Manager or Company or their employees are not responsible for any loss or injury to me or anyone using the property. I acknowledge that when I have completed this agreement, I will have entered into a binding contract with the Company/Owner, the terms of which are set forth in this agreement.
